Terms of Service

Effective: June 20, 2026

These Terms of Service ("Terms") are a binding agreement between you and Exponential Enlightenment LLC, an Illinois limited liability company ("Tycoon Tycoon," "we," "us"). They govern your use of tycoontycoon.com and the games, features, and content we offer (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use the Service

  • The games are designed for children. If you are under 13, a parent or legal guardian must read and accept these Terms on your behalf, create your account, and provide verifiable consent under our Children's Privacy Notice before you sign up.
  • If you are between 13 and 18 (or the age of majority where you live), you must have your parent or guardian's permission to use the Service.
  • Paid features may only be purchased by an adult (18+) who is the account holder and is responsible for all charges on the account.
  • You agree to provide accurate information and to keep your account credentials confidential.

2. Your account

  • You are responsible for activity that happens under your account.
  • Don't impersonate others or pick a username that is offensive, infringing, or misleading.
  • We may suspend or terminate accounts that violate these Terms, harm other users, or are inactive for an extended period.
  • You may delete your account at any time from the account page or by emailing us.

3. Acceptable use

Don't:

  • Use the Service to do anything illegal, harmful, harassing, hateful, sexual, or threatening.
  • Attempt to access another user's account, data, or game saves.
  • Probe, scan, or test for vulnerabilities; bypass rate limits; or scrape the Service at scale. Good-faith security research is welcome — email us first.
  • Reverse engineer, decompile, or otherwise try to extract source code, except to the extent the law permits this and you cannot waive it.
  • Upload, post, or generate content that is illegal, infringes someone else's rights, contains malware, or exposes other people's personal information.
  • Use automated systems, bots, or cheats to inflate scores, generate AI assets, or otherwise abuse the Service.

4. User content and AI-generated assets

  • Your content stays yours. You keep ownership of the feedback, concept submissions, brand names, and other content you create or generate using the Service.
  • License to us. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and back up your content as needed to operate and improve the Service. For public content (e.g., usernames, public leaderboards, publicly shared concepts), the license also lets us display that content to other users.
  • AI-generated assets. When you use a premium feature to generate a brand name, logo, business plan, or similar output, you may use the output as permitted by the underlying AI model provider's terms. AI outputs are not guaranteed to be unique, original, registrable as trademarks, or free of third-party rights. You are responsible for clearing rights before commercial use. We make no warranty that any AI-generated name or logo is available for trademark registration.
  • No professional advice. Business plans, market analyses, and similar outputs are for entertainment and inspiration. They are not legal, financial, tax, accounting, or investment advice.

5. Our content

The Service — including its games, code, art, audio, text, and trademarks — is owned by Exponential Enlightenment LLC or its licensors and is protected by copyright, trademark, and other laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Service for non-commercial entertainment. All rights not expressly granted are reserved.

6. Premium features, payments, and subscriptions

The core games are free to play. Some features (including AI-powered brand, logo, business plan, and similar generators) may be offered as paid one-time purchases or subscriptions. When you purchase a paid feature:

  • You authorize us and our payment processor to charge the payment method on file for the listed price plus any applicable taxes.
  • Subscriptions auto-renew at the end of each billing period at the then-current price until you cancel. We will send a renewal reminder where required by law (e.g., California Automatic Renewal Law). You may cancel at any time from the account page; cancellation takes effect at the end of the current billing period.
  • EU/UK statutory right of withdrawal: if you are a consumer in the EU or UK, you have 14 days to withdraw from a purchase. By starting to use a digital good or AI generation during that period, you expressly request immediate performance and acknowledge that you lose the right of withdrawal once the digital content has been delivered.
  • Refunds: outside the statutory right of withdrawal, paid features and consumed AI generations are generally non-refundable, except where required by law. If you believe you were charged in error, email us within 30 days and we will work with you in good faith.
  • Price changes: we may change prices for new billing periods with at least 30 days' notice.
  • Taxes: prices may exclude sales tax, VAT, or GST, which we will add at checkout where required.
  • Virtual goods and in-game currency have no real-world value, are not convertible to cash, and are non-transferable. They may be revoked for fraud or violation of these Terms.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted, secure, or error-free. Some jurisdictions do not allow the exclusion of certain warranties; in those places, the exclusions above apply to the maximum extent permitted.

8. Limitation of liability

To the maximum extent permitted by law, Exponential Enlightenment LLC and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our aggregate liability for any claim arising out of or related to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim and (b) US $100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for gross negligence, fraud, willful misconduct, or — for EU/UK consumers — liability for death or personal injury caused by our negligence.

9. Indemnification

You agree to indemnify and hold harmless Exponential Enlightenment LLC from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Service, your content, or your commercial use of any AI-generated asset.

10. Termination

We may suspend or terminate your access to the Service at any time for any reason, including if we reasonably believe you have violated these Terms. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination will survive (including 4–9, 11–13).

11. Governing law and dispute resolution

These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflicts of law rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to personal jurisdiction there. If you are a consumer outside the United States, nothing in this section deprives you of the protection of mandatory laws of your country of residence.

12. DMCA / copyright complaints

We respect copyright. If you believe content on the Service infringes your copyright, send a notice with the elements required by 17 U.S.C. § 512(c)(3) to tycoon@exponentialenlightenment.com with subject "DMCA Notice." We may remove allegedly infringing content and, in appropriate cases, terminate repeat infringers.

13. Changes

We may update these Terms from time to time. Material changes will be announced on the Service via an in-app notice on next sign-in at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance.
